Commercial Use
Commercial Use means using it for profit. Such as promoting, use it to make goods/service etc. Or we can commonly seen examples are book cover, photocard, postcard, keychain etc. Or logo/picture use in shop, profile and header in Youtube, Twitch etc. Basically, anything that involves with money, whether directly or indirectly, they're all considered as Commercial Use.To use it for Giveaway, it CAN and CAN NOT be commercial use, all depends on the artist's discretion. In fact, even it's not use for profit directly but it still create credit, reputation and other benefits which is considered as Commercial Use anyway. However, most of the artist tend to be lenient on this by considering it as a Personal Use or charging a small additional on the price instead of charging with Commercial Price.Anyway, each artist has their own rules and exceptions, so please consult with the artist about their Terms of Condition first would be best! ദ്ദി(˵ •̀ ᴗ - ˵ ) ✧
'การใช้เชิงพาณิชย์' คือการนำไปใช้เพื่อแสวงหากำไร เช่น ใช้โปรโมท ทำสินค้าหรือบริการขาย ฯลฯ หรือยกตัวอย่างที่เห็นได้ทั่วไปก็คือ ภาพปกนิยาย ของแถมที่ได้จากการสั่งซื้ออย่างโปสการ์ด โฟโต้การ์ด พวงกุญแจ ฯลฯ หรือโลโก้/ภาพที่ใช้ในกับร้านขายของ ปก/โปรไฟล์ Youtube/Twitch เป็นต้น การนำไปใช้กับสิ่งใดที่มีเงินเป็นส่วนเกี่ยวข้อง ไม่ว่าจะทางตรงหรือทางอ้อม ล้วนถูกนับว่าเป็นการใช้เชิงพาณิชย์ทั้งสิ้นส่วนการนำไปทำ giveaway นั้นสามารถเป็นและไม่เป็นเชิงพาณิชย์ค่ะ ขึ้นอยู่กับดุลพินิจของนักวาด เพราะตามตรงแล้วการทำ giveaway นั้นต่อให้จะไม่ได้นำไปประกอบการขายหรือโปรโมทเพื่อรายได้โดยตรง แต่การทำแจกฟรีก็เป็นการสร้างเครดิต ชื่อเสียง และผลพลอยได้อื่น ๆ ซึ่งนับเป็นการใช้เชิงพาณิชย์ได้เช่นกัน แต่นักวาดส่วนมากมักจะอะลุ่มอะล่วยให้โดยคิดเป็น Personal Use แทน หรือชาร์จราคาเพิ่มอีกนิดหน่อยแทนการคิดราคาเชิงพาณิชย์นักวาดแต่ละคนจะมีกฎและข้อยกเว้นที่แตกต่างกันไป พูดคุยสอบถามกับนักวาดกันก่อนเพื่อความเข้าใจที่ตรงกันจะดีที่สุดค่ะ ദ്ദി(˵ •̀ ᴗ - ˵ ) ✧
As for me, doing a Giveaway to give it away for special day or at the event under your own name and you are not the organizer or doing anything for your own benefits, I considered it as a Personal Use.//in case it is for your artist/idol 's benefit, that's absolutely okay!
